Terms of use
Effective 27 October 2026
1. Scope and provider
These terms govern the use of Affliq: the iOS app, the web portal at app.affliq.com and the creator pages under your handle (for example yourname.affliq.com). The provider is Markus Schwed, Tempelstraße 7, 66773 Schwalbach, Deutschland, email info@affliq.com (“we”).
Affliq is made for creators who work independently and act as entrepreneurs within the meaning of section 14 of the German Civil Code (BGB). If you use Affliq as a consumer (section 13 BGB), these terms apply as well; mandatory consumer rights remain unaffected, and provisions that expressly apply only to entrepreneurs do not apply to you.
Your own terms do not apply, even if we do not expressly object to them.
2. Account and conclusion of the contract
To use Affliq you need an account, created with Apple, Google or an email address and password. By creating the account you accept these terms, and the contract of use is concluded. The presentation of Affliq in the App Store and on affliq.com is not yet an offer.
You must be of age or have the consent of your legal guardians. Your details must be accurate. You keep your access secret, are responsible for what happens through your account, and tell us at info@affliq.com if you suspect misuse.
An account belongs to one creator business. Other people, such as an assistant, may use it only where Affliq provides a membership of their own for that.
3. Services
Affliq is the back office for creators: deals with deliverables and deadlines, invoices with e-invoice (XRechnung and ZUGFeRD), cancellation invoices and corrections, sending invoices by email, benefits in kind with a log, platform payouts and affiliate commissions, expenses, receipts (screenshots, photos, emails, documents), reminders by notification, a calendar subscription of your deadlines, a yearly tax package and exports for bookkeeping (DATEV, sevDesk, lexoffice), and a page of your own under your handle with links, imprint and privacy notice.
The current version of the app and the web portal describes the exact scope. There are no limits on the number of records; technical limits, such as the size of uploaded files, are stated in the app where they apply.
4. Trial
Every new account can use Affliq with all features free of charge for 30 days from its creation. No payment details are needed. The trial ends by itself and does not turn into a paid subscription.
Each creator gets the trial once. Repeating it with further accounts is not allowed.
Seven days before the end we tell you the date in the app, in the web portal and by email. If you do not subscribe by then, section 7 applies to your account.
5. Subscription, prices and payment
After the trial, adding and changing records requires a subscription: “Affliq Creator”, monthly or yearly. It includes all features of Affliq without limits.
You subscribe in the app as an in-app purchase through the App Store. Apple handles purchase and payment; Apple charges the price to the payment method of your Apple ID and issues the invoice. Apple’s Media Services Terms apply in addition. We do not receive payment details. At present the subscription is only available through the App Store.
The price shown to you in the app before the purchase applies, including the VAT of your country.
The subscription applies to the Affliq account in which you take it out and is tied to the Apple ID you buy it with. If you restore the purchase in another Affliq account, the subscription applies to that account from then on and no longer to the previous one. Family Sharing is not available.
Price changes for running subscriptions go through Apple: Apple announces an increase in advance and asks for your consent where required. If you do not consent, the subscription ends at the end of the current period.
You request refunds from Apple, which decides on them under its terms. If Apple refunds a period, the subscription ends with the refund.
6. Renewal and cancellation of the subscription
The subscription renews automatically for the chosen term, one month or one year, unless you turn renewal off at least 24 hours before the end of the current period.
You cancel at any time in the subscription settings of your Apple ID, on the iPhone under Settings → your name → Subscriptions, or in Affliq under Profile → Subscription. Cancellation takes effect at the end of the current period; until then you can use Affliq in full. You also switch between monthly and yearly there; Apple determines when the switch takes effect.
Deleting your Affliq account does not end a subscription with Apple. Cancel it with Apple first, otherwise it keeps renewing.
7. Payment problems and an account without a subscription
If a renewal fails, Apple retries the payment. For up to 16 days you can keep using Affliq in full; we tell you by notification and email.
When the trial or the subscription ends, your account remains and nothing is deleted. You can sign in, view all records, invoices and receipts, download the tax package and the exports, change your settings and delete your account.
No longer possible then: new or changed records, issuing and sending invoices, imports, accepting forwarded emails and uploaded receipts, and reminders. Your page under your handle, including imprint, privacy notice and short links, is no longer reachable; the handle stays reserved for you.
We tell you the date in advance in the app and by email: when you turn renewal off, when a payment fails, and seven days before the end. You are responsible for an imprint that is reachable elsewhere afterwards and for links pointing to your page.
When you subscribe again, everything is available as before.
8. Access without a subscription
We may unlock accounts without a subscription, for example for partners and testers before launch. There is no entitlement to this. If such access has an end, we tell you seven days in advance; section 7 applies afterwards.
Purchases in test versions through TestFlight are Apple test purchases without payment. They unlock Affliq only temporarily.
9. Invoices and sending by email
You issue invoices, cancellation invoices and corrections yourself; Affliq is your tool for it. You are responsible for their content: the details in your legal profile (such as tax number, VAT ID and small-business status), the services, amounts and recipients, and the tax case, which you check before issuing. Affliq assigns invoice numbers consecutively in the format you set.
An issued invoice can no longer be changed, only cancelled or corrected; Affliq creates a cancellation invoice for that. We check the e-invoice technically against EN 16931; we cannot promise that your recipients’ systems accept it.
When you send an invoice by email through Affliq, we send it on your behalf from info@affliq.com, with your name as sender and your address for replies. You choose recipients and text and make sure you may write to the recipients. We cannot guarantee delivery. What you agreed with your customers about invoices and payments remains unaffected.
You fulfil your statutory retention duties yourself. Affliq keeps your records available as long as your account exists, and you can export them at any time.
10. Receipts and automatic reading
You decide which screenshots, photos, emails, documents and details you store in Affliq. Affliq reads receipts automatically, also with the help of an AI service (see the privacy notice). The values read are suggestions that you confirm or change; only then do they become records.
The receipts themselves remain unchanged. Stamped copies and logs that Affliq makes for benefits in kind are readable versions of your details; whether they suffice as evidence is for your tax adviser to judge.
11. Your page, imprint and legal texts
Under your handle you publish a page with your links, discount codes and content. You are responsible for that content, for labelling advertising, and for links and codes being correct.
Affliq creates the imprint and privacy notice of your page from your legal profile as a template. You check whether they are complete and correct for your business and keep your legal profile up to date.
You can change your handle at most every 90 days; the previous one then redirects to the new one for 90 days. We may withdraw a handle that infringes the rights of others, misleads about your identity or imitates a platform or brand.
Anyone can report illegal content on creator pages to info@affliq.com. If we restrict your page or content, we tell you with reasons; you can object at the same address.
12. Rights in content and in Affliq
The rights in your content stay with you. For the term of the contract you grant us the simple right to store, process and copy it as far as Affliq needs to, to make it publicly available on your page, and to transmit it with your invoices to the recipients you choose. We do not use your content to train AI models.
You warrant that you may use the content you store in and publish through Affliq, and you indemnify us against third-party claims based on a culpable breach of this warranty.
Affliq itself, its software, design and brand, remains ours. For the term of the contract you receive the simple, non-transferable right to use Affliq within these terms.
13. Third-party data (processing on your behalf)
Your records contain personal data of third parties, such as contacts at your partners, recipients of your invoices, senders of forwarded emails and visitors to your page. You are the controller of these data; we process them as a processor (Art. 28 GDPR) only to provide Affliq to you and on your instructions, which you give by using Affliq.
Everyone with access at our end is bound to confidentiality. We protect the data by hosting in Germany, encrypted transmission, encrypted storage of tax numbers and tokens, and daily backups. As sub-processors we use the recipients named in the privacy notice; we inform you about new ones in advance, and you can object.
We support you with requests from data subjects, notify you of breaches of these data without undue delay, and keep them available for export until the end of the contract. When you delete your account, we delete them.
14. No tax or legal advice
Affliq keeps your records and compiles them. Affliq derives the tax case of an invoice or payout from your details, such as your partner’s seat and VAT ID; that is a help to fill in, not advice, and you check the result before issuing.
Affliq does not tell you what counts for tax, what is deductible or what the law requires. The tax package is a compilation of your data for your tax adviser and does not replace them. Figures such as the fulfillment rate are calculated from your records; they are not statements of the platforms.
15. Independence from platforms
Affliq is an independent service with no connection to TikTok, Instagram, YouTube, Twitch, Amazon or other platforms and their operators. Your rights and duties towards a platform are governed solely by its terms. Affliq does not post or act in your platform accounts.
16. Permitted use and suspension
The account is meant for your own creator business. Not allowed are in particular: storing or publishing illegal content, using the reading feature in an automated or abusive way, scraping, copying or reverse engineering Affliq except where the law permits it, interfering with its operation, and repeating the trial with further accounts.
In case of a breach we may remove content, restrict features or suspend the account. We first ask you to stop the breach, except for serious breaches or where the law requires immediate action. You can still export your records as far as the law permits.
17. Availability and development
We aim for high availability but do not owe uninterrupted use. We schedule maintenance for times of low use where possible.
We develop Affliq continuously and may change it as far as this is reasonable for you, for example to improve it, to adapt it to law or platforms, or to make it more secure. If we significantly restrict features that matter to you, we announce this at least six weeks in advance; you can then cancel a running subscription at the end of its period. Your records remain exportable in any case.
18. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and where we have given a guarantee.
For simple negligence we are liable only for breach of essential contractual duties, those whose fulfilment makes the use of Affliq possible in the first place and on which you may rely, and then limited to the foreseeable damage typical for the contract.
Unless the first paragraph applies, we are not liable for disadvantages from values read or tax cases derived that you did not check, from details and deadlines you did not enter or entered wrongly in Affliq, or from emails not delivered. For loss of data we are liable only to the extent it would not have occurred with regular exports by you.
19. Term, termination and deletion
The contract of use runs for an indefinite period. You can end it at any time by deleting your account in the app under Profile → Delete account, in the web portal under Account, or by writing to info@affliq.com. You cancel a subscription with Apple yourself in addition (section 6).
We may terminate the contract with six weeks’ notice. If you have already paid for the time after that, we refund that share. Both sides’ right to terminate for good cause remains unaffected.
Deletion removes all records, receipts and files permanently; backups are overwritten after 14 days at the latest. Download the tax packages and exports you must keep before you delete.
20. Changes to these terms
We may change these terms when the law, case law or Affliq itself changes. We announce changes by email and in the app at least six weeks before they take effect. We do not change the price or the core service this way.
If you act as an entrepreneur, the changes are deemed accepted unless you object before they take effect; we point this out in the announcement. If you act as a consumer, we ask for your consent. If you object or do not consent, either side may terminate the contract as of the date the change takes effect.
21. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you act as a consumer, the mandatory provisions of the state of your habitual residence remain unaffected.
If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our seat.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
The language of the contract is German; the English version is for information. Should individual provisions be invalid, the rest remain valid.
